Terms of Use

1. Definitions

• "License" - These terms and conditions.
• "Licensor" - Incredevo, the copyright owner of HireFocuZ.
• "HireFocuZ" - The AI-driven recruitment platform developed by Incredevo, including software, models, algorithms, documentation, and related intellectual property.
• "Derivative Works" - Modifications, extensions, or adaptations of HireFocuZ, excluding external works that merely interface with it.
• "Contribution" - Any code, model, or enhancement intentionally submitted to Incredevo for inclusion in HireFocuZ.

2. Grant of Copyright License

Subject to this License and pre-payment of applicable license fees, Incredevo grants you a limited, non-exclusive, non-transferable, revocable license to use HireFocuZ, provided you comply with the conditions below.

This license is not royalty-free. Continued use of HireFocuZ requires a valid, active pre-paid license from Incredevo.

3. Restrictions

You may not:

• Copy, modify, create derivative works of, sublicense, distribute, or resell HireFocuZ.
• Reverse engineer, decompile, disassemble, or attempt to extract source code, models, or algorithms.
• Circumvent license controls, technical restrictions, or security mechanisms.
• Use HireFocuZ in violation of applicable laws, regulations, or third-party rights.

4. Use of AI-Generated Outputs

HireFocuZ includes AI-driven functionalities designed to optimize recruitment tasks, reduce manual work, and increase quality of hire. Users acknowledge that:

• AI outputs are probabilistic and may not always be accurate.
• Users retain full responsibility for hiring decisions based on outputs.
• HireFocuZ is a support tool, not a substitute for human judgment.
• HireFocuZ may provide data from publicly available sources; use of such data is solely at the user's discretion.
• Any contact made by the user through HireFocuZ data is the sole responsibility of the user.
• HireFocuZ is not a mass mailing tool and must not be used as such.
• Any outreach campaign executed by the user - including email, phone, or social media outreach - is the sole responsibility of the user.

5. Confidentiality

Users agree to maintain the confidentiality of HireFocuZ's proprietary models, algorithms, code, and documentation.

No part of HireFocuZ may be disclosed to third parties without Incredevo's written consent.

6. Trademarks

This License does not grant permission to use the trademarks, logos, or branding of HireFocuZ or Incredevo, except with explicit written consent from Incredevo.

7. Disclaimer of Warranty

HireFocuZ is provided on an "AS IS" basis. Incredevo and contributors disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall Incredevo or its contributors be liable for damages arising out of the use or inability to use HireFocuZ, including but not limited to lost revenue, recruitment opportunities, business interruption, or reputational harm.

9. Indemnification

You agree to indemnify, defend, and hold harmless Incredevo, its officers, employees, and contributors from any claims, damages, liabilities, or expenses (including legal fees) arising from:

• Your misuse of HireFocuZ.
• Your reliance on AI outputs.
• Any violation of this License or applicable law.

10. Termination

This License automatically terminates if:

• You fail to pay required license fees before or during the license term.
• You breach any term of this License, including restrictions on use.

Upon termination, you must immediately cease using HireFocuZ and uninstall it.

11. License Fees and Payment

• Use of HireFocuZ requires the purchase of a pre-paid license from Incredevo.
• License fees must be paid in full before the start of the license term.
• The duration and scope of usage rights correspond to the conditions specified at the time of pre-payment.
• Licenses are time-bound (subscription-based) unless otherwise agreed in writing.
• Failure to pre-pay renewal fees before the expiration date will result in automatic termination of this License.

12. Governing Law & Jurisdiction

This License shall be governed by and construed under the laws of Poland. Any disputes shall be resolved exclusively in the courts of Warsaw.

13. Acceptance of Liability or Support

Any warranties, support contracts, or service-level guarantees beyond this License must be provided in a separate written agreement with Incredevo.
